A police officer in Prince Albert has pleaded guilty to assault, but won't face any penalties.

A provincial court clerk says Michael Ozar was given a discharge after he pleaded guilty, adding he will not face any probation, conditions or time behind bars. The clerk said the conviction will be on Ozar's record for three years.

The officer admitted assaulting a woman during an altercation on Oct. 3, 2010. He pressed his boot to the back of the head of Cheryl Morin while she was being searched at the police detachment.

Morin had been brought in on a charge of intoxication and was scuffling with two guards on the floor.

Judge Henry Goliath said Thursday it wasn't clear from the video whether there was any forceful contact between Ozar's foot and Morin's head. But he said it was clear the prisoner was quite intoxicated, loud, obnoxious and very unco-operative.

He also ruled the injuries she claimed to have suffered at the police station couldn't be proved beyond a reasonable doubt.

Ozar remains suspended with pay. The Saskatchewan Public Complaints Commission will undertake an investigation legislated by the Saskatchewan Police Act.
